EMERGENCY FINANCIAL ASSISTANCE TO ELIGIBLE MUNICIPALITIES

For payment of emergency financial assistance to eligible

municipalities in accordance with the following sched

ule. The population to be used in determining eligibility for

such assistance shall be population determined according to the federal decennial census of nineteen hundred eighty. The moneys hereby made available shall be paid on audit and warrant of the comptroller on vouchers certified by the appropriate officials of each eligible municipality

of twelve million eight hundred thousand dollars ( $12,800,000), or so much thereof as may be necessary, is hereby appropriated for payment from the local assistance account of the general fund to the commissioner of

taxation and finance for deposit in the emergency highway construction and reconstruction fund for the purpose of meeting the terms of any contractual agreements between the commissioner of transportation

and the New York state thruway authority. On

before the thirtieth day next preceding the date upon which payment shall be made under cooperative highway contractual agreement between the commissioner of

transportation and the New York state thruway authority, the commissioner of taxation and finance shall certify to the director of the budget and the commissioner of transportation and the chairman of the New York state thruway authority (i) the amount of

money available in the emergency highway construction and reconstruction fund as of the date of the certification; (ii) the amount of money estimated to be deposited in such fund by the date payment shall be made; and (iii) the amount of the payment to be made under a cooperative highway contractual agreement. Upon receipt of such certification for the commissioner of taxation and finance, the director of the budget shall cause to be prepared certificate of approval of availability to enable the payment from the local assistance account of the general fund to the commissioner of taxation and finance of the amount needed to meet the cooperative

highway contractual agreement payment. No portion of this appropriation shall be available for the purpose designated until a certificate of approval

availability shall have been issued by the director of the budget and a copy of such certificate filed with the state comptroller, the chairman of the senate finance committee and the chairman of the assembly ways and means committee. Such certificate may be amended

propriated for transfer to the state lottery fund as
reimbursement for disbursements made from such fund
for supplemental aid to education pursuant to section
92-c of the state finance law that are in excess of
the amounts deposited in such fund for such purposes

pursuant to section 1612 of the tax law. Notwithstanding the provisions of any

other law, moneys hereby appropriated shall be apportioned and paid until a certificate of allocation has been approved by the director of the budget

of the tax law. Notwithstanding the provisions of any other law, no moneys hereby appropriated shall be apportioned and paid until
