CITY OF ROCHESTER

LOCAL LAW No. 1

A local law in relation to pensions.

Became a law August 15, 1927, with the approval of the Mayor, no petition protesting. Passed by the local legislative body of the city of

Rochester.

Be it enacted by the common council of the city of Rochester as follows:

Section 1. Subdivision three of section three hundred and thirty-five and subdivision three of section three hundred and thirty-six of chapter seven hundred and fifty-five of the laws of nineteen hundred and seven, entitled "An act constituting the charter of the city of Rochester," are hereby superseded, and enacted as local law, amended, respectively, to read as follows:

3. Pensions to widows and children. The commissioner of public safety has power in his discretion to grant a pension to the widow of a member who is killed in the actual performance of duty or dies from the effect of an injury received in the actual performance of duty, of an annual sum not exceeding five hundred dollars; and to grant a pension to the widow of a member retired upon a pension after twenty years' service, of an annual sum not exceeding five hundred dollars; and to grant a pension to the widow of a member who dies after fifteen years' service or after having been retired upon a pension after fifteen years' service, of an annual sum not exceeding five hundred dollars. If in addition to the widow, the deceased member leave a child or children under eighteen years of age, then the amount of pension may be divided between the widow and children in such proportion and in such manner as the commissioner of public safety may direct; and if the deceased member leave a child or children under eighteen years of age, and no widow, or if a widow, then after her death, the commissioner in his discretion may grant such pension to the child or children under eighteen years of age. If the deceased member have no widow or child, but a parent or parents wholly dependent upon him for support, the commissioner in his discretion may grant such pension to the parent or parents or to the survivor of them. If the deceased member leave no widow, child or dependent parent, but one or more brothers and sisters wholly dependent upon him, under sixteen years of age, the commissioner in his discretion may grant such pension to such brothers and sisters, to be apportioned among them as the commissioner may direct. When a member of the police force who has been retired on a pension thereafter marries, his widow and children of such marriage are not entitled to pensions under this act.

3. Pensions to widows and children. The commissioner of public safety has power in his discretion to grant a pension of an

annual sum not exceeding five hundred dollars per annum, to the widow of any member of the fire force who is killed while in the actual performance of duty or who dies from the effect of an injury received in the actual performance of duty, or who dies after fifteen years of service in the fire force or after having been retired upon a pension under this act. If, in addition to the widow, the deceased member leave a child or children under eighteen years of age, then the amount of pension may be divided between the widow and children in such proportion and in such manner as the commissioner of public safety may direct; and if the deceased member leave a child or children under eighteen years of age, and no widow, or if a widow, then after her death, the commissioner, in his discretion, may grant such pension to the child or children under eighteen years of age. If he leaves no widow or child, but a parent or parents wholly dependent upon him for support, the commissioner, in his discretion, may grant such pension to the parent or parents or to the survivor of them. If he leave no widow, child or dependent parent, but one or more brothers and sisters wholly dependent on him, under sixteen years of age, the commissioner, in his discretion, may grant such pension to such brothers and sisters to be apportioned among them as the commissioner may direct. When a member of the fire force who has been retired on a pension thereafter marries, his widow and children of such marriage are not entitled to pensions under this act.

§ 2. Upon the taking effect of this local law the commissioner of public safety shall have power, in his discretion, to increase any pension heretofore granted the widow of any policeman or fireman, or the children, dependent parents or dependent brothers or sisters of any deceased policeman or fireman, but in no case shall any pension exceed the sum of five hundred dollars. § 3. This local law shall take effect August fifteen, nineteen hundred and twenty-seven.

LOCAL LAW No. 2

A local law to amend a local law entitled "A local law amending generally and supplementing an act constituting the charter of the city of Rochester," adopted July 28, 1925, being local law number four.

In relation to the issuance of city bonds.

Became a law October 20, 1927, with the approval of the Mayor. Passed by the local legislative body of the city of Rochester.

Be it enacted by the common council of the city of Rochester as follows: Section 1. Section two hundred and sixteen of the local law adopted by the common council, July twenty-eighth, nineteen hundred and twenty-five, entitled "A local law amending generally and supplementing an act constituting the charter of the city of Rochester," is hereby amended by adding thereto the following:

The council may, however, issue bonds as heretofore for any defined general purpose including local improvements and to fund notes issued for such purpose, upon determination after certification by the city manager that the average life of improvements within such general purpose exceeds a stated period, and such bonds shall mature within such period. No annual installment of principal of such bonds shall be more than twice the amount of any preceding installment.

§ 2. This local law shall take effect on the first day of January, nineteen hundred and twenty-eight.

LOCAL LAW No. 3

A local law to amend a local law entitled "A local law amending generally and supplementing an act constituting the charter of the city of Rochester," adopted July 28, 1925, being local law number four.

In relation to the chief of police.

Became a law November 4, 1927, with the approval of the Mayor. Passed by the local legislative body of the city of Rochester.

Be it enacted by the common council of the city of Rochester, as follows:

Section 1. Section one hundred and thirty of the local law adopted by the common council, July twenty-eighth, nineteen hundred and twenty-five, entitled "A local law amending generally and supplementing an act constituting the charter of the city of Rochester," is hereby amended by adding thereto the following. On the removal of a chief of police, who, at the time of his appointment as chief of police was a member of the police force, he shall be restored at his request to the rank and duty which he held at the time of his appointment as chief of police, provided however, that such removal shall not have been after a trial upon charges as provided herein and in chapter seven hundred and fifty-five of the laws of nineteen hundred and seven, for the hearing and deciding of charges against any officer or member of the police force.

§ 2. This local law shall take effect on the first day of January, nineteen hundred and twenty-eight.

CITY OF ROME

LOCAL LAW No. 1*

A local law to amend section ninety-three of the charter of the city of Rome in respect to "special appropriations."

Became a law July 27, 1927, with the approval of the Mayor, no petition protesting. Passed by the local legislative body of the city of Rome.

Be it enacted by the common council of the city of Rome, as follows: Section 1. Section ninety-three of chapter six hundred and seventy-nine of the laws of nineteen hundred and twenty-one entitled "An act to revise the charter of the city of Rome, as amended," is hereby amended to read as follows:

§ 93. Special appropriations. Upon the recommendation of the head of a department, board, commission, or office of the city, special appropriations may be made by the board of estimate and contract for the purposes for which appropriations may be made in the annual estimate, subject, however, to action thereon by the common council as in the adoption of the annual estimate. Moneys required for such appropriations if no unappropriated moneys are available shall be provided by the issue of special certificates of indebtedness, the amount of which shall be included in the next annual estimate. Such special appropriations during any fiscal year shall not be in excess of ten thousand dollars ($10,000), except by vote of the taxpayers or other provision of law. To take effect immediately.

LOCAL LAW No. 2

A local law in relation to the salary of the mayor of the city of Rome. Became a law December 28, 1927, without the approval of the Mayor. Passed by the local legislative body of the city of Rome.

Be it enacted by the common council of the city of Rome, as follows: Section 1. Salaries. The annual salary of the mayor of the city of Rome shall be three thousand five hundred dollars.

§ 2. Section seventeen of article three of chapter six hundred and seventy-nine of the laws of nineteen hundred and twenty-one being an act to revise the charter of the city of Rome, is hereby modified so far as the same is inconsisent with the foregoing.

This local law shall take effect January first, nineteen hundred and twenty-eight.

LOCAL LAW No. 3

A local law entitled "An act to amend the charter in relation to the application of surplus funds in the bureau of water.

Became a law December 22, 1927, with the approval of the Mayor. Passed by the local legislative body of the city of Rome.

Be it enacted by the common council of the city of Rome, as follows: Section 1. Subsection four of section eighty-eight of chapter six hundred and seventy-nine of the laws of nineteen hundred and twenty-one entitled "An act to revise the charter of the city of Rome, as amended," is hereby amended to read as follows:

4. The balance of such surplus fund shall be set aside in separate fund and held subject to the appropriations of the board of estimate and contract for the retirement of any portion of the city water supply debt for which a sinking fund has not been provided and for extensions and additions or renewals of the water supply system of the city.

§ 2. This act shall take effect immediately.
