Upon motion that the rules be suspended and the resolution can be adopted, the roll call resulted: Ayes: Becker, Bone, Craig, Daniels, Ferris, Gandy, Gayman, Hogg, Levy, Logan, Lydick, Maxwell, Noffsinger, Prouty, Ross, Taylor, Walker, Woods, Mr. Speaker, 19; absent, Ballinger, Bryan, Fuller, Ingmire, Jester, McBride, Robinson, 7. The motion carried.

House Joint Resolution No. 5 was read the second time and adopted upon roll call as follows: Ayes: Becker, Bone, Craig, Daniels, Ferris, Gandy, Gayman, Hogg, Levy, Logan, Lydick, Maxwell, Noffsinger, Prouty, Ross, Taylor, Walker, Woods, Mr. Speaker, 19; absent, Ballinger, Bryan, Fuller, Ingmire, Jester, McBride and Robinson, 7.

Upon motion by Mr. Wood that the House adjourn, the roll was called and resulted: Ayes: Becker, Craig, Ferris, Gayman, Hogg, Levy, Logan, Maxwell, Noffsinger, Prouty, Taylor, Walker, Wood, Mr. Speaker, 14; nays: Bone, Daniels, Gandy, Ross, 4; absent, .Ballinger, Bryan, Fuller, Ingmire, Jester, Lydick, McBride and Robinson, 7.

The motion carried and the House adjourned.

AFTERNOON SESSION.

The House reconvened with the Speaker in the chair.

Mr. Gandy moved that the House resolve itself into a Committee of the Whole for the purpose of considering bills on the Calendar. The motion carried.

The Speaker invited Mr. Bone to the chair.

The Committee of the Whole arose and reported as follows:

The Committee of the Whole having had under consideration House Bill No. 54, recommend that the same do pass as amended by the Committee, and House Bill No. 71 do pass.

The report was adopted.

Mr. Daniels asked that the records be corrected in regard to his mileage. The Speaker ordered the correction made.

Mr. Noffsinger moved that when the House. do adjourn it adjourn until Monday, 2 o'clock P. M., January 30, 1905. The motion carried. Upon motion by Mr. Becker the House adjourned.

The House convened pursuant to adjournment with the Speaker in the chair.

Prayer was offered by the Chaplain.

Upon roll call all members were present except Mr. Jester, excused.

The Journal of January 28 was read and approved.

The Committee on Agriculture reported as follows:

The Committee on Agriculture recommend that House Bill No.. 91 do not pass.

Mr. Daniels moved that as a substitute to the report of the Committee on Agriculture, the bill be placed on the Calendar. The motion was. lost.

The report of the Commtitee on Agriculture was adopted.

The Committee on Fish and Game asked for and was granted further time to report.

Mr. Noffsinger offered House Joint Resolution No. 6 as follows:

"Be it Resolved by the Eighth Legislative Assembly of the Territory of Oklahoma that,

"Whereas, the Territory of Oklahoma has a considerable amount of funds in the suspended Capitol National Bank of Guthrie; and,

"Whereas, the people of Oklahoma are desirous of knowing the condition of said institution and the probability of recovering said funds;

"Therefore, Be it Resolved, that the Eighth Legislative Assembly of the Territory of Oklahoma most respectfully petition and request, that you permit a committee from the Legislature to examine into the condition of the suspended Capitol National Bank of Guthrie in so far as the funds of the Territory of Oklahoma are concerned; and,

"Be it Further Resolved, that a copy of these resolutions be transmitted to President Roosevelt, Honorable B. S. McGuire, and the Comptroller of the Currency."

Mr. Ferris offered House Concurrent Resolution No. 4, as follows: "Be it Resolved by the House of Representatives of the Eighth Legislative Assembly, the Council concurring therein, that

"First: The condition of Oklahoma and Indian Territory are sorely in need of immediate statehood and our conditions will eminently warrant the same at the present term of Congress, and,

"Whereas, the Senate of the United States is soon to take a vote on said measure, which is of great importance to every citizen of the two Territories, and,

"Whereas, both and all of the great political parties of this fair Territory have views similar, and the same, and are in all things agreed that such a measure is vitally important, and that such a measure do pass at this term of Congress, and,
