Mr. Robinson moved that the bill, as amended, be engrossed and placed upon its final passage. The motion carried.

Mr. Lydick moved that the House resolve itself into a Committee of the Whole for the purpose of considering bills on the calendar. The motion was lost.

On Mr. Ballinger's motion the House adjourned until 10 o'clock A. M., January 25, 1905.

MORNING SESSION.

The House convened pursuant to adjournment, with the Speaker in the chair.

Prayer was offered by the Chaplain.

The roll call showed all members present except Mr. Jester, excused by the Speaker.

The Journal of the previous day was read and approved.

The Committee on Judiciary reported as follows:

Mr. Speaker:

The Committee on Judiciary recommend that House Bills Nos. 104, 6, 68 and 49, as amended by the Committee do pass; that Nos. , 46, 52, 97, 40, 79, 3 and 44 do not pass.

It was moved that the report be adopted.

Mr. Ferris moved to amend the motion by having House Bill No. 79 printed and placed upon the calendar.

On roll call the vote was as follows: Ayes: Craig, Daniels, Ferris, uller, Gayman, Hogg, Ingmire, Levy, Logan, Lydick, Maxwell, Prouty, Robinson, Ross, Walker, Woods, and Mr. Speaker, 17; nays: Ballinger, Becker, Bone, Gandy, McBride, Noffsinger, Taylor, 7; present and not voting, Bryan, 1; absent, Jester, 1. The motion by Ferris carried.

Mr. Walker moved that the House resolve itself into the Committee of the Whole for the purpose of considering House Bill No. 58 and other bills on the calendar. The motion carried. Mr. Gandy was asked to take the chair.

The Committee of the Whole arose and reported as follows:

Mr. Speaker:

The Committee of the Whole, having had under consideration House Bill No. 58, recommend that it be made a Special Order for Thursday, at 2 o'clock; that the substitute for House Bill No. 7 do

pass; that House Bill No. 15 do pass; that House Bill No. 23 be made a special order for Tuesday, January 31, at 2 P. M. The report was adopted.

Mr. Robinson offered an amendment to House Bill No. 15 as follows:

That at the end of Section 1 the following be added: "Provide, however, that nothing contained herein shall prevent the respective officers or clerk and assessor to be held by the same person." The amendment was accepted.

Mr. Robinson moved that House Bill No. 7 and 15 be ordered engrossed, and placed on their third reading and final passage. The motion carried..

Upon motion the House adjourned.

AFTERNOON SESSION.

The House reconvened at 2 o'clock P. M., with the Speaker in the chair.

Mr. Prouty had unanimous consent to introduce House Concurrent Resolution No. 3.

The following message was received from the Council:

I have the honor to transmit through you, to the House, Council Joint Resolution No. 1, Council Concurrent Resolution No. 1, Council Memorial No. 3, which have passed the Council.
