AN ACT in relation to the payment of certain taxes to the town of Santa Clara, Franklin county, and making an appropriation therefor.

Became a law April 11, 1914, with the approval of the Governor. Passed, three-fifths being present.

The People of the State of New York, represented in Senate and Assembly, do enact as follows:

Section 1. The sum of three thousand two hundred and ninetyeight dollars and sixty-seven cents ($3,298.67) is hereby appropriated out of any moneys in the state treasury not otherwise appropriated for the payment to the town of Santa Clara, Franklin county, of the amount of taxes assessed or which should have been assessed, pursuant to section twenty-two of the tax law, for the years eighteen hundred and ninety-nine to nineteen hundred and eleven, both inclusive, upon the real property in such town purchased by the state of New York and conveyed to Cornell university for the purposes of a college of forestry, pursuant to chapter one hundred and twenty-two of the laws of eighteen hundred and ninety-eight, the title to which real property has been finally declared and determined by the courts of the state to be in the state of New York by reason of the failure of Cornell university to use the same for the purposes intended by such act.1 Such sum shall be payable by the treasurer on the warrant and audit of the comptroller to the supervisor of such town for general town purposes.

§ 2. This act shall take effect immediately.

'AN ACT to create a commission to investigate provision for the mentally deficient and making an appropriation for its

The People of the State of New York, represented in Senate and Assembly, do enact as follows:

Section 1. A commission is hereby created, consisting of five persons to be appointed by the governor. The governor shall designate one of the members appointed by him as chairman of Vacancies. the commission. It shall be the duty of such commission to investigate the subject of the public provision for the care, custody, treatment and training of the mentally deficient, including epileptics.

AN ACT to provide for the acquisition by the state of certain real property in the town of Cortland, Westchester county, for military and naval purposes, and making a reappropriation therefor. Became a law April 11, 1914, with the approval of the Governor. Passed, three-fifths being present.

The People of the State of New York, represented in Senate and Assembly, do enact as follows:

Section 1. The armory commission of the third brigade disauthorized. trict is hereby authorized and empowered to enter upon, acquire and take possession of any lands, structures and waters for the purpose of rifle practice and other military or naval purposes deemed necessary by the armory commission in the town of Cortland, Westchester county, the appropriation of which, in its judgment, shall be necessary for any of said purposes. Upon the request of such armory commission an accurate map and description of such lands so to be appropriated shall be made by the state engineer and surveyor, and certified by him to be correct, and such armory commission or a majority thereof shall endorse on such map and description a certificate stating that the lands described therein have been appropriated by the state for the purposes aforesaid or any of them, and such map and description description. shall be filed in the office of the secretary of state and a duplicate Notice of thereof in the office of the register of Westchester county. armory commission shall thereupon serve upon the owner of any real property so appropriated a notice of the filing and date of the filing of such map and description in the secretary of state's office, together with a copy of such map and description, which notice shall also specifically describe that portion of the property belonging to such owner which has been so appropriated. If such armory commission shall not be able to serve such notice upon the owner personally within this state after making efforts so to do which in its judgment are under the circumstances reasonable and proper, it may serve the same by filing with the clerk of Westchester county. From the time of the service of such notice, the entry upon and the appropriation by the state of the property described for the purposes above mentioned or any of them shall be deemed complete, and thereupon such property shall be deemed to be and shall become the property of the state.
