CITY OF SALAMANCA

LOCAL LAW No. 1*

A local law relative to the powers of the commissioners of water and light of the city of Salamanca.

Became a law November 1, 1926, with the approval of the Acting Mayor, nc petition protesting. Passed by the local legislative body of the city of Salamanca.

Be it enacted by the common council of the city of Salamanca, as follows: Section 1. Section seventy-seven of the charter of the city of Salamanca, being chapter five hundred and seven of the laws of nineteen hundred and thirteen, as amended, is hereby amended to read as follows:

§ 77. Powers and duties of the board. The municipal water and light works of the city of Salamanca shall be under the control and supervision of the board of water and light commissioners. Neither the common council of said city, nor the board of water and light commissioners shall have the power or authority to sell or lease said municipal water and light system to any person or persons, corporation or corporations, except when authorized by a vote of the resident owners of taxable property, over the age of twenty-one years, of the city at a special election; except that the board of water and light commissioners with the approval of the common council may enter into a contract with any telephone, telegraph, railroad, or other public service corporation providing for the joint ownership, use and construction of any poles, wires, or transmission or distribution lines of the system whenever it may appear proper to the said commissioners to make such agreement, and on such terms and conditions as the said commissioners may approve. CITY OF SCHENECTADY

LOCAL LAW No. 1

A local law amending chapter one hundred eighty-two of the laws of nineteen hundred seven as amended by chapter three hundred seventy-nine of the laws of nineteen hundred eleven, entitled "An act to establish a permanent firemen's pension fund for the city of Schenectady, New York."

Became a law March 30, 1926, with the approval of the Mayor. Passed by the local legislative body of the city of Schenectady.

Be it enacted by the common council of the city of Schenectady:

Section 1. Section one of chapter one hundred and eighty-two of

the laws of nineteen hundred and seven, entitled "An act to establish a permanent firemen's pension fund for the city of Schenectady, New York," is hereby amended to read as follows:

§ 1. The mayor of the city of Schenectady for the time being (and his successors in office), the comptroller of the city of Schenectady for the time being (and his successors in office), the commissioner of public safety of the city of Schenectady for the time being (and his successors in office) and two members of the permanent fire department of the city of Schenectady, who shall be elected in the manner provided by this section, shall constitute a board of trustees of the firemen's pension fund, hereinafter mentioned. The chief of the fire department of the city of Schenectady, shall on or before December first of each year in which a mayor shall be elected, call a meeting of said fire department to be held on the first Tuesday following the first Monday in December of such year for the purpose of electing two members of said department to be trustees of the said firemen's pension fund. Each member of said department shall be entitled to vote for two members of said fire department for the office of trustee of the said fund. Voting shall be by ballot and shall be secret. The two members having the highest vote shall be declared elected. The chief of the fire department shall designate two members of said department who shall with himself, canvass the votes and declare the result. The two members of the fire department so elected as trustees of said fund shall take office on the first day of January following such election and shall serve for two years. In the event that a vacancy shall occur in the office of a trustee so elected, the chief of the fire department shall appoint a member of the fire department to fill such office of trustee for the remainder of the unexpired term. The chief of the fire department, immediately after the passage of this local law, shall appoint two members of the permanent fire department to act as trustees until their successors are elected in the manner prescribed above. mayor of the city of Schenectady shall be president of said board, the commissioner of public safety of the city of Schenectady shall be secretary of said board and the comptroller of the city of

Schenectady shall be treasurer of said board. Said board of trustees shall have charge of and administer said fund and from time to time invest the same or any part thereof as they shall deem most beneficial to said fund, in such securities as savings banks, of the state of New York are permitted to invest in, and are empowered to make all necessary contracts, and take all necessary and proper action and proceedings in the premises, and to make payments from said fund or pensions granted in pursuance to this chapter. The said trustees shall from time to time establish such rules and regulations for the administration of the firemen's pension fund as they may deem best. They shall report in detail the condition of the fund at the close of each fiscal year of the fire department, through their secretary, to the common council, and said report shall be published with the annual report of the fire department. No payment whatever shall be allowed or made by said trustees as rewards, gratuities or compensation to any person for salary or services rendered to or for said board of trustees.

§ 2. Subdivision three of section two of chapter one hundred and eighty-two of the laws of nineteen hundred and seven in relation to the establishment of a permanent firemen's pension fund of the city of Schenectady, New York, is hereby amended to read as follows:

3. There shall be deducted each month from the compensation of each member of said permanent fire force one per centum of the monthly salary of such member, which shall be paid monthly to and received and held by the custodian of the fire pension fund for the use and benefit thereof.

§ 3. The opening paragraph and subdivision one, three, four and five of section three of chapter one hundred and eighty-two of the laws of nineteen hundred and seven in relation to the establishment of a permanent firemen's pension fund of the city of Schenectady, New York, as amended by chapter three hundred and seventy-nine of the laws of nineteen hundred and eleven are hereby amended to read as follows:

§ 3. The board of trustees shall have power, in their discretion to retire and dismiss from membership in said fire force, and thereupon grant pensions as hereinafter provided, to any member of the fire force of said city who shall have become disabled, mentally or physically, to widows, children or next of kin of such members, to be paid from the firemen's pension fund by the board of trustees thereof, as follows:

1. To the widow of any member of the fire department who shall have been killed in the actual performance of duty, or who shall have died from the effects of any injury received while in the actual performance of such duty, or who shall have died from the effects of any sickness contracted while in the actual performance of such duty, or who shall have died after five or more years of continuous active service in said department, and whose death occurs while said member is in active service therein, the sum of one thousand dollars ($1,000.00), provided said widow shall at the time of such

death been living with such member, but if there be no such widow, and there be a child or children, then to said child or children of such member in equal proportions, and if there be no such child or children then the said sum of one thousand dollars ($1,000.00) shall be paid to the estate of the deceased member. A member of the said department shall be construed to be "in active service" when he is on the payroll as a permanent member of said fire department.

3. The board of trustees may release and dismiss from the force and service any member of the fire department upon a certificate of the city physician or a licensed physician selected by the trustees, showing that such member of whatever age, who has served twenty years is permanently disabled, physically or mentally, so as to be unfit for duty, and place upon the roll of the firemen's pension fund and award and grant to be paid to such member, from said firemen's pension fund, an annual pension during his lifetime, of onehalf of the full salary or compensation of such member at the time of such retirement. Any member of the permanent fire department who has served continuously for twenty-five years may apply to the board of trustees to be placed upon the roll of the firemen's pension fund and receive from said firemen's pension fund an annual pension during his lifetime of one-half of the full salary · or compensation of such member at the time of such retirement. Retirement after twenty-five years' service shall take effect on the date specified by the member in his application for retirement after such service under this section. The said period of twenty-five years of service must be one of continuous active service, except in the case of official leave of absence, and in that case the said applicant should have made up by active service, the lost time by said official leave of absence and he shall serve such time as to constitute an actual record of at least twenty-five years active service before such application for retirement. This provision for retirement after twenty-five years service is not mandatory, but is discretionary with said officer or member. The pensions granted under this section shall be for the natural life of the pensioner and shall not be revoked, repealed or dismissed.

4. The board of trustees may, in their discretion, order any pension granted, or any part thereof to cease, except in the cases of members of the fire force retired after twenty years or twentyfive years, as provided in the last preceding section, but in all cases the said board of trustees shall file a written statement of the reasons which caused them to order any pension to so cease and nothing herein contained shall render the granting or payment of such pensions obligatory to the commissioner of public safety or upon the trustees of the firemen's pension fund or chargeable as a matter of right upon said permanent firemen's pension fund, except as provided in the last preceding section.

5. No member of the fire force shall be awarded, granted or paid a pension on account of physical or mental disability or disease unless upon the certificate of the city physician or a licensed physician selected by the board of trustees, which shall set forth

the cause, nature and extent of the disability, disease or injury of the member of the fire force who may be placed upon the pensionroll, and said certificate shall state distinctly whether or not such disability, disease or injury was incurred or sustained by said member of the fire force in the performance of fire duty, and such certificate shall in each case, be filed with and entered upon the records in the office of the commissioner of public safety. All or any sums of money in trust with the comptroller of the city of Schenectady, known as the permanent firemen's relief or pension fund, that has been obtained by public subscriptions, entertainments and voluntary assessments shall within thirty days after the passage and approval of this act revert to and shall be a part of and applied to in each and every case as contained in the provisions of this act. § 4. This local law shall take effect immediately.

LOCAL LAW No. 2

A local law amending chapter one hundred eighty-three of the laws of nineteen hundred seven as amended by chapter three hundred seventy-eight of the laws of nineteen hundred seventeen, entitled “An act to establish a police pension fund for the city of Schenectady, New York.”

Became a law March 30, 1926, with the approval of the Mayor. Passed by the local legislative body of the city of Schenectady.

Be it enacted by the common council of the city of Schenectady as follows:

Section 1. Subdivisions one and three of section three of chapter one hundred and eighty-three of the laws of nineteen hundred and seven entitled "An act to establish a police pension fund for the city of Schenectady, New York," as amended by chapter three hundred and seventy-eight of the laws of nineteen hundred and seventeen are hereby amended to read as follows:

1. To the designated beneficiary of any member of the police force who shall have been killed in the actual performance of duty or who shall have died from the effect of any injury received while in the actual performance of such duty the sum of one thousand ($1,000.00) dollars. To the designated beneficiary of any member of the police force who shall have died after five or more years of continuous active service in said police department, and while said member is in active service therein, but whose death shall not have occurred as above specified, the sum of five hundred ($500.00) dollars. The beneficiary entitled to receive either of the above mentioned sums shall be designated by the members of said police force in writing, and such written designation shall be filed in the office of the comptroller of the city of Schenectady, N. Y. In the event no beneficiary shall have been so designated, or the last designated beneficiary shall have died, then the said sum of one thousand ($1,000.00) dollars or five hundred ($500.00) dollars, as the case may be shall be paid to the estate of the deceased member. The members of the police force shall be permitted to change the
