4. Persons of the age of fourteen years and under

§ 1203. Advisory commission for physically handicapped persons. There is hereby continued an advisory commission for physically handicapped persons, to be composed of the commissioner of education, who shall be chairman, of the state industrial commissioner, of the commissioner of health and of the president of the state board of charities. Any member of the commission may designate an officer in his department to represent him on the commission and the acts of such offieer shall be deemed to be the acts of the person who designated him. The commissioner of education shall designate the officer of the department of education charged with the administration of this act to act as secretary to the commission.

§ 17. Such chapter twenty-one of the laws of nineteen hundred and nine, as amended by chapter one hundred and forty of the laws of nineteen hundred and ten, is hereby amended by adding a new section, to be section twelve hundred and three-a, to read as follows:

§ 1203-a. Purpose of the commission. The purpose of the commission shall be:

1. To rehabilitate persons over fourteen years of age needing and susceptible of rehabilitation for remunerative occupations.

2. To stimulate all private and public efforts designed to relieve, care for, cure or educate physically handicapped children, and to coordinate such efforts with the work and functions of governmental agencies.

§ 18. The opening paragraph of section twelve hundred and four of such chapter twenty-one of the laws of nineteen hundred and nine, as added by chapter seven hundred and sixty of the laws of nineteen hundred and twenty, is hereby amended to read as follows:

§ 1204. Power of the commission. The commission shall have power and it shall be its duty:

8. To maintain a register of physically handicapped children and to use all means and measures necessary to adequately meet the physical and educational needs of such children, as provided by law.

4. Make, within the limits of the appropriations made therefor, physical examination of physically handicapped children who are

prospectively or actually incapacitated for the normal pursuit of an education and make recommendations for treatment.

5. On its own initiative or on request of the commission provide, within the limits of the appropriations made therefor, such surgical, medical or therapeutic treatment or hospital care and necessary appliances and devices for physically handicapped children as in its judgment are needed.

§ 21. Section twelve hundred and eight of such chapter twenty- added to one of the laws of nineteen hundred and nine, as added by chapter 1208. seven hundred and sixty of the laws of nineteen hundred and twenty, is hereby amended by adding a new subdivision, to be subdivision eleven, to read as follows:

11. To provide, within the limits of the appropriations made therefor, home-teaching, transportation, scholarships in non-residence schools, tuition or maintenance and tuition in elementary, secondary, higher, special and technical schools, for physically handicapped children, in whole or in part from funds of the department, when not otherwise provided by parents, guardians, local authorities or by other sources public or private.

§ 22. Such chapter twenty-one of the laws of nineteen hundred & 1208a and nine, as amended by chapter one hundred and forty of the laws of nineteen hundred and ten, is hereby amended by adding a new section, to be section twelve hundred and eight-a, to read as follows:

§ 1208-a. Duty of the state board of charities. It shall be the duty of the state board of charities to report to the advisory commission for handicapped persons from time to time handicapped children under eighteen years of age in institutions or under the supervision of organizations coming under the visitation of the board and such other information as the board deems advisable. § 23. The titles to article thirty-nine-a and section ten hundred Art. 39a and twenty of such chapter twenty-one of the laws of nineteen titles hundred and nine, as added by chapter five hundred and fifty-nine of the laws of nineteen hundred and seventeen, are hereby amended to read as follows:

Nothing in this act shall affect the powers and duties of saving the commissioner of education relative to medical inspection un- clause. der article twenty-a of the education law, except in so far as this act provides for the surgical or therapeutic treatment or hospital care of crippled children by the state department of health. This act shall not apply to or affect or modify any of the provisions of article thirty-eight of the education law, relative to the instruction of the deaf and blind.

§ 26. In addition and supplemental to the appropriations which shall be made in the appropriation act of nineteen hundred and twenty-five for the purpose of carrying out the powers and duties prescribed in article forty-seven of the education law for the fiscal year beginning July first, nineteen hundred and twenty-five, there is hereby appropriated, from any moneys in the treasury not otherwise appropriated, the sum of twenty-five thousand dollars ($25,000), or so much thereof as may be necessary, to the department of education, for the purpose of carrying into effect the provisions of article forty-seven of the education law as hereby amended and of paying the cost of the performance of the duties and the exercise of the powers imposed or conferred by such article, and the sum of fifteen thousand dollars ($15,000), or so much thereof as may be necessary, to the department of health, for the purpose of carrying into effect the provisions of this act and of paying the cost of the performance of the duties and the exercise of the powers imposed or conferred thereby.

§ 27. This act shall take effect July first, nineteen hundred and twenty-five.

CHAPTER 228

AN ACT to create a commission to investigate and report upon the suburban passenger transportation problem of the city of New York and its environs, and making an appropriation therefor.

Became a law April 1, 1925, with the approval of the Governor. Passed, three-fifths being present.

The People of the State of New York, represented in Senate and Assembly, do enact as follows:

Section 1. A commission is hereby created for the purpose of this act to consist of eleven members, to be appointed as follows: three of such members to be appointed by the governor, four of such members to be appointed by the president pro tem of the senate and four of such members to be appointed by the speaker of the assembly. The commission shall meet as soon after its appointment as convenient and select a chairman from among its members and appoint a secretary. Such commission shall investigate conditions affecting, and the requirements of, the suburban and commuter passenger traffic entering the city of New York and all matters related thereto or connected therewith, and report to the governor and the legislature on or before February first, nineteen hundred and twenty-six its conclusions and recommendations in respect thereto.

§ 2. Eligibility. A member of the commission shall not be disqualified in holding any other office, state or municipal, nor forfeit the same by reason of his appointment under this act, notwithstanding the provisions of any law of the state or city charter.

§ 3. Powers of the commission. Such commission shall have power to subpoena and compel the attendance of witnesses, including public officers and employees, and to require the production of

any and all books, records and papers under their care or control, to take and hear proofs and testimony and adopt rules for the conduct of its proceedings.

§ 4. Officers and employees. The commission may employ counsel and such engineering, clerical and other assistants as may be necessary in connection with the duties of the commission, and may fix their compensation within amounts made available therefor by appropriation.

§ 5. Expenses of commission. The members of such commission shall receive no compensation for their services, but such members and the employees of the commission shall be paid for their actual and necessary traveling, hotel and other expenses incurred in the discharge of their duties.

§ 6. AN ACT making an appropriation for printing, equipment, supplies and materials for the office of the department of state police, recently destroyed

by fire.

The People of the State of New York, represented in Senate and Assembly, do enact as follows:

Section 1. The sum of nine thousand three hundred thirty-two dollars ($9,332), or so much thereof as may be necessary, is hereby appropriated out of any moneys in the state treasury not otherwise appropriated, for printing and the purchase of equipment, supplies and materials for the office of the department of state police, such office and contents having recently been injured or destroyed by fire. The moneys hereby appropriated shall be paid. out by the state treasurer on the warrant of the state comptroller, on the order of the superintendent of state police.

§ 2. This act shall take effect immediately.

AN ACT making appropriations from the sinking funds of the state for the payment of interest on the state debt.

Section 1. The several amounts named below, or so much thereof as may be sufficient to accomplish the purposes designated, are hereby appropriated from the several state sinking funds for the payment of the interest on the state debt, as the same shall become due and payable during the fiscal year beginning on the first day of July, nineteen hundred and twenty-five, namely:

CANAL DEBT SINKING FUNDS.

§ 2. Fund three. For interest on twenty-one million dollars fifty-year three per centum bonds for the improvement of the Erie, Champlain and Oswego canals, contracted under article seven of the constitution, chapter one hundred and forty-seven, laws of nineteen hundred and three and chapter three hundred and two, laws of nineteen hundred and six, six hundred and thirty thousand dollars ($630,000).

§ 3. Fund four. For interest on forty million dollars fiftyyear four per centum bonds for the improvement of the Erie, Champlain and Oswego canals, contracted under article seven of the constitution, chapter one hundred and forty-seven, laws of nineteen hundred and three and chapter sixty-six, laws of nineteen hundred and ten, one million six hundred thousand dollars ($1,600,000).

§ 4. Fund five. For interest on three million dollars fifty-year four per centum bonds for the improvement of the Cayuga and Seneca canals, contracted under article seven of the constitution, chapter three hundred and ninety-one, laws of nineteen hundred and nine, and chapter one hundred and thirty-nine, laws of nineteen hundred and ten, one hundred and twenty thousand dollars ($120,000).

§ 5. Fund six. For interest on five million dollars thirty-year four per centum bonds for the construction of barge canal terminals, contracted under article seven of the constitution, chapter seven hundred and forty-six, laws of nineteen hundred and eleven, two hundred thousand dollars ($200,000).

§ 6. Fund seven. For interest on thirty million dollars fiftyyear four and one-half per centum bonds for the improvement of the Erie, Champlain and Oswego canals, contracted under article seven of the constitution, chapter one hundred and forty-seven, laws of nineteen hundred and three, and chapter seven hundred and eighty-seven, laws of nineteen hundred and thirteen, one million three hundred and fifty thousand dollars ($1,350,000).
