(6) Have power to provide for the protection and propagation of fish and game in said parks and for the reforestation of the same. § 143. Purposes of parks and parkways. Such parks and parkIways shall forever be reserved and maintained by the state for the use and enjoyment of the public. No fee shall be charged for entrance to or passing through any part thereof. It shall be the duty of the commission to preserve such reservations and parks in their natural condition so far as may be consistent with their use and safety and to improve them in such manner as not to lessen their natural scenic beauty.

§ 144. Gifts of property for purposes of reservations and parks. Real and personal property may be granted, conveyed, bequeathed or devised to and taken by the state in aid of the purposes of such reservations and parks, or to increase the same, and on such trusts and conditions as may be prescribed by the grantors or devisors thereof, provided the same be accepted by such commission. All such property shall be maintained and controlled by the commission, and the net rents, issues, income and profits thereof shall be used exclusively for the purpose of improving such reservations and parks.

§ 145. Annual report; quarterly accounts. The commission shall make an annual report of its proceedings to the legislature in the month of January, with a detailed statement of all its receipts and expenditures for the preceding fiscal year and an estimate of the work necessary to be done, and all the expenses of maintaining the reservations and parks for the ensuing fiscal year, with such recommendations as it shall see fit to make. The commission shall I quarterly, on the first day of January, April, July and October of each year, send to the comptroller a detailed statement and itemized account of all receipts and expenditures, with vouchers for each item thereof for the preceding quarter; and such accounts shall be verified by the commissioners or the treasurer of the commission.

§ 146. Payment of moneys appropriated. Moneys appropriated for the care and maintenance of such reservations and parks and for carrying out the provisions of this article shall be paid to the treasurer of the commission by the state treasurer, upon the warrant of the comptroller. Upon the request of the treasurer of such commission the comptroller may advance from time to time out of moneys appropriated, whatever moneys he shall determine to be necessary for the purpose of carrying out the provisions of this article.

§ 150. Taconic state park commission. There is hereby created the Taconic state park commission consisting of five persons to be appointed by the governor by and with the advice and consent of the senate. The term of a commissioner shall be five years from the first day of February of the calendar year in which he shall be appointed, excepting that the commissioners first appointed shall be appointed for such terms that the term of one commissioner shall expire on the thirty-first day of January, nineteen hundred and twenty-six, and the term of one commissioner shall expire on the thirty-first day of January of each year thereafter. Upon the expiration of any term, the successors shall be appointed in like manner for a full term. Vacancies shall be filled by appointments for the unexpired term. Of the commissioners on said commission, at least three shall reside in the district within which the commission is authorized to exercise its powers. No member of such commission shall receive any compensation, but shall be entitled to his actual and necessary expenses in performing the duties of his office.

§ 151. Officers; treasurer's undertaking. The commission shall select from its members a chairman, a vice-chairman, and a treasurer. The commission shall select a secretary who may be from among its members; if a commissioner is selected as secretary he may also act as treasurer. The treasurer shall give an official undertaking in such sum as the commission shall determine.

§ 152. Powers and duties of commission. Such commission shall

(1) Have power to establish state parks and parkways and to acquire lands for such purposes, when moneys have been appropriated therefor, within the counties of Columbia, Dutchess, Putnam and Rensselaer, such lands to be acquired by purchase, or by entry and appropriation under the provisions of section fifty-nine of the conservation law, or by condemnation under the provisions of chapter nine hundred and twenty-three of the laws of nineteen hundred and twenty, known as the condemnation law, and amendments thereto.

(2) Have the control and management of any park or parkway so established and make and enforce rules and regulations necessary to effect the purposes thereof not inconsistent with law.

(3) Employ such persons as may be provided for by appropriation to assist in the management and to care for such parks and

parkways, and fix their compensation within the amounts appropriated therefor.

(4) Have power to sell all personal property, supplies, chattels, material and profits a prendre which it determines to be not necessary or desirable for the uses and purposes of such reservations and parks, and have power and authority, notwithstanding the provisions of section thirty-seven of the state finance law, to expend all moneys received from the sale of such personal property, supplies, chattels, material and profits a prendre and from the operation of the park and concessions thereon for the extension, development, operation and maintenance of such reservations and parks in such manner as the commission may determine.

(5) Have power to fix the price to be charged by drivers of public conveyances for carrying persons for hire within the limits of such parks, and the price to be charged by guides for their services.

(6) Have power to provide for the protection and propagation of fish and game in said parks and for the reforestation of the

same.

(7) Have power, with the approval of the state council of parks, evidenced by the formal order of such council, to assume jurisdiction, management and control of the Taconic state park under the provisions of this article, and this commission shall thereupon become vested with all the powers and charged with all the duties specially relating to said park possessed by and charged upon the state council of parks immediately preceding the adoption of such formal order, and thereupon such powers and duties of the state council of parks shall cease and determine.

§ 153. Purposes of parks and parkways. Such parks and parkways shall forever be reserved and maintained by the state for the use and enjoyment of the public. It shall be the duty of the commission to preserve such reservations and parks in their natural conditions so far as may be consistent with their use and safety and to improve them in such manner as not to lessen their natural scenic beauty.

Except as herein otherwise specially provided, nothing herein contained shall operate to limit, curtail, modify or repeal any power or authority now vested in or duty imposed upon any existing board, commission, council, society or officer in relation to public parks, parkways, reservations and scenic and historic sites and buildings.

§ 8. Article fifteen of the public lands law, as renumbered by chapter nine hundred and thirty-two of the laws of nineteen hundred and twenty, is hereby renumbered article seventeen thereof, and section one hundred and forty2 of article seventeen thereof, as hereby renumbered, is renumbered section one hundred and sixty. § 9. This act shall take effect immediately.

CHAPTER 199

AN ACT to amend the benevolent orders law, in relation to mortgaging

property.

Became a law April 1, 1925, with the approval of the Governor. Passed, three-fifths being present.

The People of the State of New York, represented in Senate and Assembly, do enact as follows:

Section 1. Section ten of chapter eleven of the laws of nineteen hundred and nine, entitled "An act relating to benevolent orders, constituting chapter three of the consolidated laws," as last amended by chapter three hundred and seven of the laws of nineteen hundred and eleven, is hereby amended to read as follows: 2 As amended by L. 1921, ch. 308.

§ 10. Mortgaging property. If the funds of the corporation shall not be sufficient to pay for any real property purchased by the board of trustees in pursuance of law, or for the construction, repair or rebuilding of a suitable building or buildings, and the finishing or furnishing of apartments therefor, the corporation may issue its bonds bearing interest, semi-annually, for such additional sum as may be required therefor, and may execute to any such trustee or trustees, as the board may select, a mortgage upon its real property as security for the payment of such bonds 'or the corporation may borrow such additional sum as may be required therefor of any person or corporation and execute and deliver its bond for the moneys so borrowed and secure the payment thereof by mortgage upon its real property as collateral thereto. The proceeds of such bonds or such bond and mortgage2 shall be applied to the payment of debts of the corporation incurred by the purchase of such real property, or the construction and repair of a building or buildings thereupon or the finishing or furnishing of apartments therein. Any of the bodies specified in section seven may invest its funds in the bonds authorized by this section to be issued. Such corporation shall have authority also to borrow of any person or corporation such sum as in the judgment of its board of trustees may be required to pay the cost of the construction, repair, rebuilding or reconstruction of any such building or buildings, and the finishing or furnishing of apartments therein, and to secure the payment of any moneys so borrowed, and to execute and deliver its bond for the sum so borrowed, and to secure the payment of the same by mortgage upon its real property as collateral thereto.

§ 2. This act shall take effect immediately.

AN ACT to amend chapter four hundred and six of the laws of nineteen hundred and ten, entitled "An act to incorporate the Xavier Alumni Sodality of the city of New York," in relation to changes in organization to be effected by the constitution of such corporation.
