BUSINESS LYING ON PRESIDENT'S DESK.

The following letter, accompanying the report of Arizona Mental Hygiene Survey, was read:

"To the Honorable President and Members of the State Sen-
ate, Sixth Legislature of the State of Arizona:

Pursuant to the provisions of Senate Concurrent Reso-
lution No. 3, of the Fifth State Legislature, 1921, there is
transmitted herewith Report of the Arizona Mental Hygiene
Survey, with Recommendations, conducted by The National
Committee for Mental Hygiene, Inc., Thomas H. Haines,
M. D., Director of the Survey.

A carbon copy of this Survey has been transmitted to Dr. A. M. Tuthill, Chairman, under whose direction I am advised same is being printed and will be available for distribution within a short time.

Senate Concurrent Resolution No. 3, above referred to provides that 'such data and information as is gathered on the subject be by him (The Legislative Reference Librarian) compiled and prepared for presentation to the next session of the Arizona State Legislature.'

The above communication, together with report therein mentioned,was referred to the Committee on Public Health and Statistics.

The President announced that Senator MacMillin was excused for today and tomorrow in order that he might attend conference of Commanders of the American Legion.

ORDER OF THE DAY.

Moved by Senator Rutherford, duly seconded, that Senate Resolution No. 2, be referred to Committee on Banking and Insurance, with instructions that two thousand copies be printed. Carried.

INTRODUCTION AND FIRST READING OF BILLS.

House Bill No. 7, introduced by the Committee on Appropriations, entitled "An Act making an appropriation for the current and contingent expenses of carrying on and conducting and defraying the expenses of the State Legislature of the State of Arizona for the Session of 1923 and declaring an emergency" was read in full and, under suspension of the rules, was referred to the Appropriation Committee.

Moved by Senator Roberts, duly seconded, that the Committee

report an amendment to House Bill No. 7, so as to segregate the total legislative appropriation, to the House and Senate, appropriating a specific sum to the House, and a specific sum to the Senate. Carried.

Moved by Senator Roberts, duly seconded, that the Committee be instructed to report House Bill No. 7 back and that it be made a matter of Special Order of Business, at 3 o'clock this afternoon. Carried.

REFERENCE OF BILLS.

Senate Bill No. 3, in re State Land Department, was read by number and title and referred to Committee on Public Lands.

Senate Bill No. 4, in re State Librarian, was read by number and title and referred to Committee on Public Institutions.

Senate Bill No. 5, in re Suits Against the State, was read by number and title and referred to Committee on Judiciary.

Senate Bill No. 6, in re Board of Regents of the University, was read by number and title and referred to Committee on Public_Institutions.

At the request of Senator Sims, the following communication was read, its incorporation in the Journal ordered, and referred to the Committee on Agriculture and Irrigation:

This is in answer to your communication of January 6th to Mr. Ballard.

We have bored three holes in the river at Glen Canyon and located bed rock at the center of the river 67 feet, 155 feet to the right of the center 82 feet, and 135 feet to the left of the center 28 feet, which we consider a very satisfactory bottom and which demonstrates that it is entirely practicable to build a dam at this point. We encountered very few boulders on top of the rock which further simplified dam construction.

The following report was received from the Committee on Corporations:

Your Committee on Corporations reports that it has examined Senate Bill No. 2, entitled 'An Act to Amend Par. 2100, Chap. 11, Title 9, Revised Statutes of Arizona, 1913, Civil Code, as amended by Chapter 29 of the Acts of the Special Session of the Fifth Legislature (Session Laws 1922) and declaring an emergency', and respectfully recommends that it do pass.

Senate Bill No. 2, in re Corporations, by the President, ordered placed on the calendar of the Committee of the Whole.

At 10:40 A. M., the Senate resolved itself into a Committee of the Whole, Senator Rutherford in the chair.

At 11:20 o'clock A. M., the President resumed the chair, and declared the Senate in session.

At 11:25 o'clock A. M., the Committee of the Whole reported as follows:

Your Committee of the Whole, having had under consideration Senate Bill No. 2, respectfully recommends that it be recommitted to the Committee on Judiciary.

At 11:30 o'clock A. M., moved by Senator Sims, duly seconded that the Senate stand at recess until 2 o'clock P. M. Carried.

At 2 o'clock P. M., the Senate reconvened, President Winsor in the chair.

REPORT OF STANDING COMMITTEES. The following report from the Committee on Appropriations was read:

Mr. President:

"January 12, 1923.

Your Committee on Appropriations reports that it has examined House Bill No. 7, entitled 'An Act making an appropriation for the current and contingent expenses of carrying on and conducting and defraying the expenses of the State Legislature of the State of Arizona for the Session of 1923, and declaring an emergency,' and respectfully recommends that Section 1 be amended to read as follows:

'Section 1. That the sum of Eighty Thousand Six Hundred Eighty-six ($80,686.00) Dollars, or so much thereof

as may be necessary, is hereby appropriated out of the General Fund now in the hands of the State Treasurer of the State of Arizona, for the several objects and purposes hereinafter named.

(1) That the sum of Twenty-seven Thousand Three Hundred ($27,300.00) Dollars is hereby appropriated for the payment of the salaries of the members of the First Session of the Legislature of the State of Arizona for the year 1923.

(2) That the sum of Twenty-seven Thousand ($27,000.00) Dollars, or so much thereof as may be necessary, is hereby appropriated for the payment of employees of the Sixth Session of the State Legislature of Arizona for the year 1923, Twelve Thousand ($12,000.00) Dollars, or as much thereof as may be necessary, for payment of employees of the Senate; and Fifteen Thousand ($15,000.00.00) Dollars, or so much thereof as may be necessary, for payment of employees of the House.

(3) That the sum of Two Thousand, Three Hundred Eighty-six ($2,386.00) Dollars, or so much thereof as may be necessary, is hereby appropriated for the payment of mileage of the members of said Legislature.

(4) That the sum of Twenty-two Thousand ($22,000.00) Dollars, or so much thereof as may be necessary, is hereby appropriated for the payment of contingent expenses of said Legislature for the year 1923, Eleven Thousand ($11,000.00) Dollars, or so much thereof as may be necessary, for payment of contingent expenses of the Senate; and Eleven Thousand ($11,000.00) Dollars, or SO much thereof as may be necessary, for the payment of contingent expenses of the House.

(5) The sum of Two Thousand ($2,000.00) Dollars, or so much thereof as may be necessary, is hereby appropriated for the necessary expenses to be incurred in completing the records of the Legislature, indexing the Journals of both Houses, and completing the official records of both Houses of the Regular Session of the Sixth Legislature of the State of Arizona, for the year 1923.'

and respectfully recommends that Section 2 be amended to read as follows:

'Section 2. All claims for salaries and mileage for the members of the respective Houses of the Legislature shall be honored by the State Auditor upon the presentation of a certificate signed by the presiding officers of the respective Houses of the State Legislature, whereupon the State Auditor shall issue his warrant upon the State Treasurer for the payment of the same, and the State Treasurer, upon presentation, shall pay the same out of the General Fund herein provided for.'

and respectfully recommends that House Bill No. 7 as amended do pass.

Moved by Senator Sims, duly seconded, that the report of Committee on Appropriations be adopted. Carried.

Moved by Senator Sims, duly seconded, that the rules be suspended and that House Bill No. 7 be placed on second reading by number and title only. Carried.

SECOND READING OF BILLS.

House Bill No. 7 was read by number and title only, and upon motion of Senator Sims, duly seconded, and carried, referred to the Committee on Enrolling and Engrossing, under suspension of the rules.

At 2:45 o'clock P. M., the President declared a recess, subject to the call of the gavel.

At 3:25 o'clock P. M., the Senate reconvened, President Winsor in the chair.

At 3:30 o'clock P. M., upon motion of Senator Elliott, duly seconded, and carried, Senate adjourned until 10 o'clock A. M., January 13, 1923.

BUSINESS LYING ON PRESIDENT'S DESK.
The following letter from the Governor was received and read:
"January 13, 1923.

My Dear Mr. Winsor:

I am herewith transmitting for the information of the Senate and such action as may be deemed proper by the Legislature, a letter addressed to me under date of January 12, 1923, by Mr. Frank R. Goodman, State Engineer. I particularly want to call your attention to Section Four of the Letter which reads as follows:

'Section 4 of the report shows the emergency appropriation necessary to carry on the work until March 1, 1923.

Owing to the fact that our funds are entirely exhausted
